Welcome to Meisaku ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Meisaku website (https://meisaku.art), services, and community features (collectively, the "Services").
By accessing, registering for, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.
- General Access: You must be at least 13 years old (or 16 years old depending on your local jurisdiction, such as within the EU) to create an account and use the Services.
- NSFW Content: To view, search, or upload Not Safe for Work (NSFW) or mature content, you must be at least 18 years of age. Falsely representing your age to bypass this restriction is a strict violation of these Terms and will result in immediate account termination.
You are responsible for maintaining the confidentiality of your login credentials (including third-party social logins) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Meisaku claims no ownership rights over the artworks, images, text, or other content ("User Content") that you upload to the platform. You retain all copyrights and intellectual property rights to your work.
By uploading User Content, you grant Meisaku a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your content solely for the purpose of operating, maintaining, and promoting the Services.
- Our Guarantee: Meisaku will never use, sell, or license your User Content to train artificial intelligence (AI) models, machine learning algorithms, or generative image systems.
- Third-Party Scraping: We strictly prohibit any third party from using automated scripts, bots, or scraping tools to harvest User Content from Meisaku for the purpose of AI training or any other unauthorized use.
By using Meisaku, you agree not to:
- Upload, post, or share any content that is illegal, incites violence, or promotes terrorism.
- Upload Child Sexual Abuse Material (CSAM). Any such content will be immediately reported to the appropriate international authorities (such as NCMEC) and the account will be permanently banned.
- Harass, threaten, or doxx other users.
- Upload stolen artwork or content that infringes on the copyright, trademark, or intellectual property rights of others.
- Spam the platform, manipulate engagement metrics, or distribute malware.
Meisaku allows the posting of NSFW and mature content, provided it is legal and adheres to our community guidelines.
- All NSFW content must be properly tagged and categorized upon upload.
- Attempting to bypass the age-gate or deliberately mislabeling NSFW content as Safe for Work (SFW) may result in content removal or account suspension.
If you participate in premium subscriptions, commissions, or purchases on Meisaku:
- All payments are processed through secure, third-party payment providers (e.g., Stripe, PayPal). Meisaku does not process or store your financial information.
- All sales are final and non-refundable unless otherwise required by law or explicitly stated by the third-party payment processor's policies.
- You are responsible for any taxes associated with your sales or purchases on the platform.
We respect the intellectual property rights of others. If you believe your copyrighted work has been uploaded to Meisaku without authorization, please send a takedown notice to our support team containing:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing (including the specific URL).
- Your contact information (name, email address).
- A statement that you have a good faith belief that the use of the material is not authorized.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice or liability, if you violate these Terms or engage in conduct that harms the platform, our infrastructure, or other users.
- "As Is" Service: The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Meisaku makes no warranties, express or implied, regarding the reliability, availability, or performance of the platform.
- Data Loss: While we employ strong security and backup measures, we are not liable for any loss of data or User Content. You are encouraged to keep backups of your artwork.
- Liability: To the maximum extent permitted by law, Meisaku shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our primary operating entity is established, without regard to its conflict of law provisions. Disputes arising from these Terms will be resolved in the competent courts of that jurisdiction.
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on the website or via email. Your continued use of the Services after such modifications constitutes your acceptance of the new Terms.
